1. General
These General Terms and Conditions of Sale (GTCS) apply to all paid and free services and products offered by Portes du Soleil Suisse SA (PDS Suisse). The purchaser accepts them fully and without reservation.
PDS Suisse reserves the right to modify the GTC, at any time and without notice, by publishing a new version on the site (which cancels and replaces the pre-existing version).
By making a purchase after the publication by PDS Switzerland of a new version of the GTC, the customer expressly accepts the new GTC.
A copy is available at all times from the ticket offices of the Champéry - Les Crosets - Champoussin - Morgins ski lifts and can be downloaded online at www.pds-ch.ch.
2. Transport clauses
During its period of validity, the ticket entitles the holder to free circulation on the purchased sector during the published operating hours. Observance of these hours requires suitable weather, snow and track conditions.
Customers must carry a valid ticket for the period in question, corresponding to the appropriate user category.
PDS Switzerland guarantees the safety of its customers on board its facilities. To the extent permitted, PDS Switzerland's liability is limited to its own negligent or intentional conduct.
The customer undertakes to comply with all operating regulations. In particular, the customer must behave in a way that does not jeopardize his own safety or that of other users of the site. They are liable for any damage or deterioration.
3. Packages
The pass consists of an AXESS-type medium (smart card) on which a ticket is recorded.
Tickets are strictly personal and non-transferable. They cannot be exchanged, extended or modified. A photo is mandatory for passes of 8 days or more. Last name, first name, date of birth and home address are also required for season and ½ season passes.
SUPPORTS
For stays of 2 days or more, ski pass prices are reduced. In return for this reduction, the purchaser of the lift pass assumes the risk of any deterioration in weather conditions that may limit access to the lifts.
All public fares for tickets and smartcards are available at points of sale and online at www.pds-ch.ch. Prices are in CHF and include all taxes.
It is the customer's responsibility to find out about the products and prices on offer, in order to select the most advantageous for him.

Nota bene
For 5-hour to 15-day ski passes: if you start your day's skiing in Champéry, Les Crosets, Champoussin or Morgins, you must buy your ski pass at a ticket office in one of the above-mentioned resorts, or on the skipass-pds-ch.ch or one of its partners in Switzerland (RailAway, Ticket Corner...) Holders of 5-hour to 15-day ski passes purchased in France must start their day's skiing in a French resort of the Portes du Soleil, otherwise they will have to pay a surcharge to unlock the pass.
4. Payment
The means of payment accepted at the cash desk are :
Visa, Mastercard, American Express, Diners, Postcard, Maestro, Twint, Reka-Card
Cash (CHF and Euros)*) and REKA Cheques**
A sales receipt is issued for each package issued, and must be kept until the package expires.
* Payments in Euros are made in banknotes; coins are not accepted. Change is given in CHF.
**No change is given for REKA cheques.
EXCHANGE RATES
All packages are sold in CHF. The exchange rate applied at the cash desk for cash payments in Euro is updated regularly to keep pace with market variations.
The exchange rates applied on the terminals for credit card payments or purchases via our online sales site are determined by the companies issuing the payment terminals. PDS Suisse has no control over these rates; it is the customer's sole responsibility to check that the rates applied are correct when paying in a foreign currency. PDS Suisse is in no way responsible for unfavorable exchange rates.
CUSTOMER'S RIGHT OF REVOCATION
The customer cannot revoke an order once it has been paid for.
5. Buy online
Online purchasing is available at www.pds-ch.ch.
The purchase of an online ticket is subject to the present general terms and conditions of sale, unless otherwise specified below.
SPECIFIC CONDITIONS
Online sales enable the customer to purchase the package (smart card and ticket), or to recharge a smart card with a new ticket.
Anyone in possession of a smart card can top it up using the WTP number on the card (XXXXXXXX-XXX-XXX).
Order lead time
It is the customer's responsibility to correctly fill in the information required to issue or recharge the ticket.
The order must be placed :
- For a first order by post: 8 days before the first day of validity of the package
- For a first order with pick-up at a cash desk or vending machine: 1 hour before the start of the package's validity
- For a top-up: 1 hour before the start of validity of the package
Payment
Secure payment by Visa - PostFinance - Mastercard - TWINT - PostFinance - E-Finance and Masterpass.
Payment is made in a secure Worldline environment. Transmitted banking data are protected. Worldline complies with the legal provisions in force. The validated order will only be effective once the relevant bank payment center has given its approval. In the event of refusal by the aforementioned center, the order process will be cancelled.
Order confirmation
Once payment has been made and accepted by Worldline, a confirmation e-mail summarizing the entire order (confirmation number and reloaded card(s)) is sent to the customer. The customer must be able to present this order confirmation (paper printout or smartphone preview) during any checks carried out on the domain.
If a smart card is to be reloaded online, the customer can go directly to one of the PDS Suisse domain access terminals.
First-time buyers can pick up their ski pass at any ticket office in Champéry, Les Crosets, Champoussin or Morgins. To collect the ski pass, the purchaser must present the order confirmation received by e-mail and proof of identity.
Package validation
The ski pass is validated the first time you pass through an access point to the Champéry - Les Crosets - Champoussin - Morgins ski area.
Responsibilities and warranties
PDS Suisse may not be held liable for any inconvenience or damage inherent in the use of the Internet (interruption of service, external intrusion, computer virus, etc.). The customer declares that he/she is aware of the characteristics and limits of the Internet, in particular its technical performance, response times for consulting, querying or transferring data, and the risks associated with the security of communications.
6. Flat-rate replacement
LOSS / THEFT
If a pass is lost or stolen, it can be replaced on presentation of proof of purchase.
At the end of the procedure, the old ticket is cancelled. A duplicate is issued to the customer, with no possibility of modifying the ticket. The customer pays for the smart card in the same way as for a new purchase.
OUBLI
Forgotten tickets are not replaced. The user must report the omission to the ticket office and pay the price of a replacement day at the adult fare valid for the area corresponding to the forgotten pass.
The replacement day is refunded on presentation of both tickets, after checking that the forgotten ticket has not been used on the day in question. The customer must do this before the end of the current season. In this case, no refund is guaranteed.
An amount of CHF 5.00 will be deducted from the refund.
7. Refund
PARTIALLY USED OR UNUSED SECURITIES
Partially used or unused packages, whether or not due to the user, will not be reimbursed by PDS Suisse under any circumstances.
Furthermore, no postponement, transfer or other compensation will be made.
PLANT SHUTDOWN / SHUTDOWN
If Portes du Soleil Suisse SA fails to provide all or part of its services in connection with the sale of tickets or use of the facilities, either temporarily or permanently, the customer may not assert any claims against Portes du Soleil Suisse SA (in particular, no claims for restitution or damages). This rule applies in particular to interruptions or limitations of operations as well as to piste or path closures in the following circumstances:
fortuitous event
force majeure such as wind or weather conditions, avalanche danger, strike, etc
injunctions or restrictions by an authority (e.g. due to electricity shortages)
voluntary restrictions due to special circumstances (e.g. a call from the authorities to save money due to a shortage of electricity)
pandemic or epidemic
INSURANCE
Only persons who have taken out insurance cover at the time of purchase of the package may claim any reimbursement under the terms of the insurance in question. Requests for refunds should be addressed directly to the insurance company.
The purchase of insurance is linked to the purchase of a ticket. Insurance is taken out for the same duration as the ticket. Fares are available online atwww.pds-ch.chand at the cash desk.
Insurance is non-refundable.

8. Transportation exclusions
Failure to comply with operating regulations may result in exclusion from transport. In particular, if the passenger: is drunk or under the influence of drugs / behaves in an inappropriate manner / does not observe the regulations governing the use of means of transport / in the event of a pandemic does not wear a mask over the nose and mouth / does not comply with staff instructions.
In the event of a repeat offence, PDS Suisse reserves the right to stop selling tickets to users who fail to comply with operating regulations.
9. Rescue service
In the event of an accident on PDS Switzerland property and the use of a rescue service, an amount determined by the intervention rates communicated by the RMS, not including material costs, is invoiced to the accident customer. Third-party costs (e.g. Rega, doctor) are borne directly by the customer. Any claims for reimbursement must be submitted to the customer's insurance company.
10. Customer relations

Special requests must reach us no later than 7 days after the closing date of the Swiss part of the domain.
With a view to constant improvement, requests will always be received with attention and treated with kindness within 10 days.
11. Personal data and fraud
Anyone travelling on the lifts without a valid ticket or with a third-party pass will be charged a supplement of CHF 250 + the purchase of a day pass at the adult rate with chip card. If he fails to pay immediately, he will be asked to provide guarantees. Failure to do so may result in exclusion from transport.
In addition, any misuse of a ticket may result in the irreversible confiscation of the pass.
In the event of a repeat offence, PDS Suisse reserves the right to stop selling tickets to users affected by abusive or fraudulent practices.
Checks may be carried out at each installation, if necessary by computerized means. Users must be able to prove their identity, in addition to their package.
To operate its facilities and combat fraud, Les Portes du Soleil Suisse SA implements an automated control system that includes image capture at access points and an algorithmic analysis system.
Such processing is carried out in accordance with the Swiss Federal Data Protection Act (LPD), the European General Data Protection Regulation (RGPD) where applicable, and all other applicable legislation.
Collection of personal data
Portes du Soleil Suisse SA collects personal data in the following ways:
1. Information provided voluntarily by the user
When purchasing tickets, accessing services or interacting with our services, the user may be asked to provide personal data such as: first name, surname, e-mail address, postal address, telephone number, date of birth, proof of entitlement to specific fares, order information.
Payment data is never stored by the Operator. They are processed exclusively and securely by our Saferpay-approved payment service providers.
2. Information collected automatically via our website and digital platforms
When browsing our websites, online stores or social networks, we may automatically collect information relating to the use of these services, in particular: browsing preferences, pages viewed, time spent on certain sections, origin of connection, order history, technical terminal data (IP address, type of device, browser, etc.).
This data is used to ensure the smooth running of our services, to improve the user experience and, where the user has consented, to offer personalized content.
3. Information collected automatically at access gates and control equipment
When passengers pass through the access kiosks, the Operator automatically collects: technical data linked to the ticket (number, validity, category, etc.), passage information (time-stamp, facility used, checkpoint), images captured by the cameras installed at the gates, digital fingerprints generated by the algorithmic analysis system designed to detect fraudulent use.
4. Information collected by integrated third-party services
The use of services provided by third parties on our site (Google Maps™, YouTube™, audience measurement tools, etc.) may lead these service providers to collect, via their own technologies, certain personal data.
Before using these services, we recommend that you carefully consult the privacy policies of these third-party companies, as the Operator is not responsible for their personal data practices.
12. Applicable law / Jurisdiction
Under the name "Portes du Soleil", several service providers (the lift operators of the Portes du Soleil international association) form a subscription community. All companies are fully responsible for the operation of their respective facilities and slopes. The contract of carriage is concluded in each case between the customer and the company operating the facilities. The latter is responsible for the contractual provision of the relevant services. It is also responsible for the necessary technical maintenance of the facilities and for ensuring safety (slope and avalanche services). Consequently, any liability claims - particularly in the event of accidents - must be addressed to the company responsible for the ski area or managing the facility on which the accident occurred.
The contractual relationship between PDS Suisse SA and its customers is governed by Swiss law.
The place of jurisdiction is Val-d'Illiez.
